Environmental law encompasses a broad range of actions that relate to the environment. Often, environmental impacts must be assessed at the time of development and, if impacts cannot be avoided, they must be properly monitored and mitigated. Unfortunately, even despite best intentions, the environment can be detrimentally impacted, and various parties will be liable for rectification of those impacts. At SWS Lawyers, we can assist in understanding your obligations under the various pieces of environmental legislation. In particular, we can:

  • advise on the environmental assessments and approval requirements for a development;
  • assist with environmental due diligence;
  • assist with compliance issues, including the disposal of waste and responding to regulatory investigations (including pollution investigations) undertaken by various authorities such as the NSW Environmental Protection Authority;
  • assist with environmental audits to ensure compliance obligations are being met;
  • advise on matters of contaminated land (including any associated remediation obligations);
  • draft or review contractual environmental liability clauses;
  • retain experts to advise on environmental effects (including retaining experts to complete site investigations);
  • advise and represent clients in criminal proceedings brought in relation to an environmental offence; and
  • appear in the Land and Environment Court.
