Compulsory Acquisition

Compulsory acquisitions can be a daunting and confusing experience. At SWS Lawyers, we advise on all aspects of negotiations with acquiring authorities in all types of compulsory acquisitions, and act in Land and Environment Court Class 3 Proceedings in circumstances where a landowner challenges the compensation determined by the Valuer-General.

How we can help

  • Land and Environment Court Class 3 Proceedings

Expertise

Compulsory acquisition of land often occurs due to circumstances beyond the control of a landowner. Landowners are faced with a sophisticated and well-resourced acquiring authority in a government agency (including local Councils). Our lawyers have many years of expertise in acting for parties affected by compulsory acquisitions, and are well-versed in the process of acquisition, from the time of receipt of a notice until finalisation of the acquisition.

SWS Lawyers acts on behalf of individual landowners with varying interests in land (for example, lessees or benefited parties under an easement), farmers, property developers, owners corporations (and affected strata lot owners), large and small businesses from various industries and acquiring authorities. Our services include:

  • advising on the application of the relevant legislative framework and process;
  • negotiation of compensation and terms of acquisition, including working with property and business valuers to obtain the best outcome for compensation;
  • drafting of claim forms (including, if necessary, obtaining expert reports);
  • settling a favourable claim on behalf of the landowner or acquiring authority;
  • acting on the conveyance of the acquired land; and
  • advising on and appearing in Class 3 proceedings in the Land and Environment Court.

Their approach is always professional and delivered at a standard comparable to a capital city law firm. It is the clear strategic direction that has always impressed me about the SWS team.
