Compulsory acquisition of land often occurs due to circumstances beyond the control of a landowner. Landowners are faced with a sophisticated and well-resourced acquiring authority in a government agency (including local Councils). Our lawyers have many years of expertise in acting for parties affected by compulsory acquisitions, and are well-versed in the process of acquisition, from the time of receipt of a notice until finalisation of the acquisition.

SWS Lawyers acts on behalf of individual landowners with varying interests in land (for example, lessees or benefited parties under an easement), farmers, property developers, owners corporations (and affected strata lot owners), large and small businesses from various industries and acquiring authorities.   • advising on the application of the relevant legislative framework and process;
  • negotiation of compensation and terms of acquisition, including working with property and business valuers to obtain the best outcome for compensation;
  • drafting of claim forms (including, if necessary, obtaining expert reports);
  • settling a favourable claim on behalf of the landowner or acquiring authority;
  • acting on the conveyance of the acquired land; and
  • advising on and appearing in Class 3 proceedings in the Land and Environment Court.
