Expertise

Heritage items and places can be protected under Federal and State legislation. Often, heritage places will also be regulated by the local Council. Works to heritage items and places requires consideration of additional regulations and requirements that a “normal” item or place does not require. SWS Lawyers can assist by:

  • advising on the legislation and regulations (Federal, State and Local) applicable to the particular heritage item or place;
  • advising on the rights to carry out development or maintenance that may affect a protected heritage item or place (or on a property that is within a heritage conservation area) and assisting in obtaining the necessary approval to exercise those rights;

  • liaising with experts to have heritage impact statements prepared;
  • acting in relation to the compulsory acquisition of a heritage item or place; and
