Heritage

We work with clients to understand the implications of heritage listings, heritage conservation areas and heritage laws and regulations, and how these interact with development and upkeep of items and places. Such implications are relevant to the work and business of landowners, property developers and consultants such as planners and architects.

How we can help

  • Heritage Conservation Areas and Heritage Items (Local and State)
  • Land and Environment Court Class 1 Proceedings
  • Stop Work Orders
  • Compulsory Acquisition

Expertise

Heritage items and places can be protected under Federal and State legislation. Often, heritage places will also be regulated by the local Council. Works to heritage items and places requires consideration of additional regulations and requirements that a “normal” item or place does not require. SWS Lawyers can assist by:

  • advising on the legislation and regulations (Federal, State and Local) applicable to the particular heritage item or place;
  • advising on the rights to carry out development or maintenance that may affect a protected heritage item or place (or on a property that is within a heritage conservation area) and assisting in obtaining the necessary approval to exercise those rights;
  • advising on how to protect a heritage item or place threatened by proposed development;
  • liaising with experts to have heritage impact statements prepared;
  • acting in relation to the compulsory acquisition of a heritage item or place; and
  • advising on any orders received from an authority regarding the heritage item or place.

SWS Lawyers is also experienced in acting in Class 1 proceedings involving heritage considerations.

Their approach is always professional and delivered at a standard comparable to a capital city law firm. It is the clear strategic direction that has always impressed me about the SWS team.
