Legal Professional Privilege for General and In-House Counsel – Update and Recent Cases, 27 August 2025

Legal Professional Privilege can be a tricky area to navigate for general and in-house counsel. The presentation aims to provide a refresher on the principles behind privilege as set out in the Evidence Act 1995 (NSW), how and when those principles apply to communications made or sent by in-house counsel, common missteps to watch out for, and a summary of the recent cases which touch on this very topic.

About the Presenter: Nathan Avery-Williams

Nathan is a specialist commercial litigator admitted in 2009. Prior to joining SWS Lawyers, Nathan spent time in private practice and at the Bar, specialising in Equity, Commercial and Estate matters. He also has experience in Employment, Professional Negligence, Insolvency, Property, Consumer and Construction litigation.

Nathan’s unique career path and trial experience has allowed him to develop an in-depth knowledge of the law and its practical application, procedure and the rules of evidence. He firmly believes in explaining the law in “plain English”, meticulous preparation, running cases that you can win, and settling those where the commercial benefit outweighs the risk of an uncertain result at trial.
