Andrew Windybank participates on University of Newcastle corporate discussion panel

Last week, Andrew Windybank, Principal of the Corporate and Commercial team at SWS Lawyers, presented to University of Newcastle law students at a corporate law panel on the ‘safe harbour’ from insolvent trading.  The panel was moderated by Dr Tim Connor, Senior Lecturer, Faculty of Business and Law at the University and Andrew presented alongside Emma Mos, Liquidator at Jirsch Sutherland and Greg Nyman, Head of Legal at the Greater Bank.  SWS Lawyers is a proud supporter of the University of Newcastle Law School and was pleased to be asked to speak at this event.

The discussion looked at the policy, interpretation and practical application of Section 588GA of the Corporations Act 2001 (Cth), 12 months on from its introduction to the legislation.  The provision offers a ‘safe harbour’ to company directors from personal liability for the insolvent trading of a company.  Students were given an opportunity to ask questions on the law prior to this reform, the practical application and interpretation of this provision and how the changes have impacted insolvency practitioners, lawyers and financial institutions.  If you’d like more information on this reform, please read our previous news article or contact us for more information.
